Terms and Conditions

Welcome to Driffle eSIM! These terms and conditions apply to the purchase and use of eSIMs provided by Driffle eSIM. By purchasing and using our eSIMs, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please do not use our eSIM services.

1. Definitions
1. Account: An account that allows the User to use Services provided on the Platform and receive all the benefits from it.
2. eSIM: A digital SIM embedded in a device, enabling remote activation of cellular plans without a physical SIM card.
3. Driffle eSIM: UAB Driffle, with its registered office at Vilnius, Naugarduko g. 3-401, 03231, Lithuania.
4. Platform: The website available at https://driffle.com/esim
5. Privacy Notice: Rules that set personal data and privacy protection processes applied by Driffle eSIM.
6. Service: Any of the services provided by Driffle eSIM as described in these Terms and Conditions.
7. Terms and Conditions: This set of rules that determines the rights and obligations of Users, Vendors, and Driffle eSIM, regulating the use of the Platform.
8. User: A natural person who acts in relation to these Terms and Conditions and has registered an Account on the Platform and/or intends to purchase eSim using Services provided by Driffle eSIM.
2. eSIM Service
1. Service Description: Driffle eSIM sells prepaid eSIMs with data service plans based on eSIM technology. Driffle eSIM may resell the Service through a Partner or an Agent.
3. Terms of Service
1. Registration
1. The user may register for the Service on the website.
2. The user must provide their First and Last name and a verifiable email address to register. Additionally, users may upload their profile photos and state their travel preferences. This information can be provided voluntarily.
3. The user must accept the General Terms and Conditions and the Privacy Policies to register for the Service.
2. Purchase and Activation
1. Driffle eSIM may restrict the availability of plans to some countries. Users can browse, select, and purchase from the platform.
2. By purchasing the Service, users acknowledge that they have an unlocked, eSIM-compatible device, which is a prerequisite for the Service.
3. Upon purchase, users must download the eSIM onto their device for the data plans to be configured as per the order. The eSIM will remain on the device after credit has been expended or the plan has expired. Users can choose to remove the eSIM in their phone settings at any time, but we recommend not removing the eSIM until the plan has been depleted or expired.
4. To use the Service, the user must first download the eSIM and then activate the data plan attached to the eSIM. This process may require a stable internet connection.
3. Duration and Termination
1. The Service will start immediately following a successful download of the eSIM and activation of the associated data plan.
2. The duration of the Service will be as per the terms of the plan purchased.
3. The Service will terminate either on full consumption of the plan or expiry of the plan's duration, whichever is earlier.
4. Driffle eSIM may suspend the user’s use of the Service in case of breach of user obligations mentioned below, with or without notice. Driffle eSIM reserves the right to close the account(s) of any user and to request proper payment if the user attempts to use Driffle’s credits, promotions, or referrals for the Services in a questionable manner or breaches any of these Terms & Conditions or violates any law, statute, or governmental regulation.
4. Engagement
1. The Service is provided on an "as is" and "as available" basis. Driffle eSIM will use reasonable steps to make the Service available at all times, contingent upon our and/or our service provider's ability to maintain network capacity and connection availability. However, because Driffle eSIM relies on technology and networks provided by its partners, Driffle eSIM cannot guarantee network coverage, quality, or availability of the Service.
2. Driffle eSIM partners with other entities to provide the Service. Driffle eSIM is under no obligation to inform the user if it uses services from such partners. Users agree to comply with the Terms and Conditions of our partners as well. Our primary partner is eSIMgo and their Terms and Conditions can be found here.
3. Availability of Service depends on our partners’ ability to maintain network capacity and connection availability, for which there are no guarantees.
5. User Obligations
1. User agrees to use the Service in compliance with these Terms and Conditions and to be responsible for all use of the Service.
2. User agrees to submit true, accurate, and complete registration information and to keep such information up-to-date.
3. The user agrees to keep the password confidential and will be responsible for all use of the account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is objectionable.
4. The user agrees to use the Service in accordance with all applicable laws and regulations of the user's home nation, the country of residence, and the country in which the user is present.
5. User agrees that the Service shall only be used for personal consumption.
6. Users agree that the Service shall not be used to engage in any action that is abusive, illegal, or fraudulent or that causes the Network to be impaired or damaged.
7. User agrees that the credits, promotions, and referrals for the Services shall not be used to undermine the fairness, integrity, or legitimate operation of the Program, including but not limited to, creating fake accounts or using fictitious identities to participate in the Program or receive Rewards. Driffle eSIM, in its sole discretion, reserves the right to disqualify the user from the Program and future use of our Services.
8. User agrees that Driffle eSIM may suspend the Service in case of breach of the above obligations and that the user will continue to be liable and shall pay all charges due under these Terms and Conditions in respect of the suspended Services. Note that any attempt to deliberately damage or undermine the legitimate operation of the Services and the Program may be in violation of criminal and civil laws. Driffle eSIM reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.
4. Payment Terms
1. The user may register and buy eSIMs on Driffle eSIM. Payment may be processed through an authorized agent of Driffle eSIM.
2. All eSIMs are prepaid, and prices are inclusive of any indirect taxes unless specified otherwise. Indirect Tax may be charged based on the zip code shown in the billing information related to the Credit Card Payment.
3. Indirect Taxes: Sales tax, value-added tax, and any similar levies or taxes imposed by government entities at the time of the sale of Plans.
5. Returns and Refunds Policy
1. Users will be charged upon the purchase of the eSIM.
2. Users may request a refund or a change before the installation and activation of the eSIM or if there is a known technical problem originating from Driffle eSIM after activation of the eSIM.
3. Any complaints or feedback about the Service can be sent to the support team via a composed message to [email protected].
6. Governing Law and Legal Compliance
1. This Agreement and any non-contractual obligation arising out of or in connection with it will be governed by and construed in accordance with the laws of Lithuania, and any dispute shall be dealt with in the courts there.
2. Other mandatory rules, regulations, and laws of other States or countries may also apply to your use of the Services.
3. We may be required to collect certain personal information from you to comply with legal and regulatory requirements. If we request such information from you and indicate that this is for legal or regulatory compliance, then you agree that you will provide us with the true and accurate information requested. Our use of your personal information is subject to the terms of our Privacy Policy.
7. Guidelines for Reviews
1. We may provide areas on the website to leave reviews or ratings. When posting a review, you must comply with the following criteria:
1. You should have firsthand experience with the person/entity being reviewed.
2. Your reviews should not contain abusive, racist, offensive, or hateful language.
3. Your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.
4. Your reviews should not contain references to illegal activity.
5. You should not be affiliated with competitors if posting negative reviews.
6. You should not make any conclusions about the legality of conduct.
7. You may not post any false or misleading statements.
8. You may not organize a campaign encouraging others to post reviews, whether positive or negative.
2. We may accept, reject, or remove reviews at our sole discretion. We are not obligated to screen reviews or delete reviews, even if anyone considers them objectionable or inaccurate. Reviews are not endorsed by us and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sub-licensable right and licence to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.
